Acceptable Use Policy

The rules that keep this network worth being on.

Effective date: August 20, 2026. (Supersedes any prior TeleComcepts acceptable-use terms.)

This Acceptable Use Policy ("AUP" or "Policy") describes rules that apply to any party using any products or services ("Services") provided by ADATA Holdings LLC d/b/a TeleComcepts and its affiliates ("TeleComcepts," "we," "us"), and to any user of any software application or service made available by a customer that interfaces with the Services ("User"). It is incorporated into the Terms & Rates and EULA. In the event of a conflict between this Policy and a negotiated customer agreement between TeleComcepts and a customer, the customer agreement prevails.

TeleComcepts delivers Services over an upstream carrier network (Bandwidth) and other suppliers. This Policy includes a back-to-back flow-down of our upstream carriers' acceptable-use requirements: conduct prohibited by an upstream carrier is prohibited here, and customers are responsible for flowing equivalent terms down to their own users and downstream customers.

We may modify this Policy from time to time on reasonable notice, provided via your account, by email, or by posting an updated version at telecomcepts.com. Continued use of the Services on or after the effective date of a modified Policy constitutes acceptance. If you do not agree to the modified Policy, you must stop using the Services immediately. We encourage Users to review this Policy regularly.

1. Prohibited activities

The Services may not be used for any purpose that, in TeleComcepts' sole discretion, is illegal, inappropriate, or improper ("Prohibited Activities"). The examples below are illustrative, not exhaustive.

1.1 Illegal purposes

  • Using any Service to violate any law, rule, regulation, governmental order, or industry standard in any applicable jurisdiction — including the TCPA, the Truth in Caller ID Act, the TRACED Act, FCC rules, and the rules governing the National Do Not Call Registry.
  • Engaging in threatening, abusive, harassing, defamatory, libelous, deceptive, or fraudulent behavior.

1.2 Inappropriate or improper purposes

  • Inappropriate behavior and content. Calling, messaging, storing, posting, or transmitting harmful, unsolicited, inappropriate, objectionable, threatening, or abusive material or information.
  • Falsifying users or information. Falsifying or providing misleading information — including User or customer information, intended use of the Services, or other identifying information provided to us or to other Users — and transmitting caller-ID information that is false or misleading with intent to defraud, cause harm, or wrongfully obtain anything of value.
  • Continuous or repetitive calls and messaging. Repetitive or continuous calling or messaging, including via automated means, where the activity could reasonably be expected to (or does) provoke complaints.
  • Abnormal calls and messaging. Calling or messaging that is (i) significantly in excess of your expected traffic volumes, (ii) inconsistent with the business description or intended use you provided at onboarding, or (iii) inconsistent with normal business use — particularly where it could reasonably be expected to (or does) provoke complaints. Autodialer and other short-duration or high-velocity traffic is permitted only with prior disclosure and approval, on routes designated for that traffic class; running it over conversational routes violates this Policy.
  • Unsolicited calls or messages. Transmitting calls or messages without the consent of the recipient where legally required, or failing to honor opt-out requests where legally required.
  • Long-duration calls. Calls to the same number exceeding four continuous or cumulative hours within a 24-hour period, and calls placed to specific numbers or destinations for the purpose of generating charges or fees for or with a third party.
  • Traffic pumping and arbitrage. Access stimulation, traffic pumping, toll-fraud schemes, or arbitrage designed to exploit intercarrier compensation.

2. Number use

You may only originate calls displaying numbers you own or are expressly authorized to use. Numbers assigned by TeleComcepts may be used only by your account. Each number used for emergency calling must have an accurate, current E911 registered address.

3. No activities harming the network or Services

You may not, directly or indirectly, engage in any activity that, in TeleComcepts' sole discretion, harms or interferes with (i) our network or our upstream carriers' networks, (ii) the integrity or efficacy of the Services, or (iii) other Users' use of the network and the Services. This includes probing or scanning for vulnerabilities and any attempt to bypass or exploit Service limitations, authentication, or traffic controls. Credentials and IP authorizations are yours alone to use and to protect; you are responsible for traffic authenticated as you.

4. Compliance cooperation

You must respond to compliance, traceback, and fraud inquiries from us within 24 hours. We respond to regulators and the Industry Traceback Consortium on the same clock — see our Robocall Mitigation Plan — and a failure to respond is itself a violation of this Policy. Business and wholesale customers are additionally subject to our Know Your Customer Policy.

5. Remedies

We reserve the right to take any and all actions, at law or in equity, in response to violations of this Policy or as needed to preserve the integrity of our network and Services, including, without limitation: (i) suspending or terminating the Services, including charging applicable rates and any cancellation or termination fees; (ii) cooperating with law enforcement; (iii) providing requested information to third parties who notify us that they have been harmed by a User's failure to abide by this Policy; and (iv) pursuing violations of this Policy. Charges incurred before suspension remain payable. Our failure to act is not a waiver of this right, and our exercise of these rights does not create a cause of action in any User.

6. Additional terms

Customers may be subject to additional requirements or restrictions for specific Services, as set forth in the Terms & Rates, EULA, or the customer portal — but only to the extent the customer uses those specific Services.

7. Reporting abuse

To report abuse originating from our network, or for traceback requests: [email protected] (include "TRACEBACK" in the subject for priority handling) or +1 909 583 8000.
